Our sovereign lord, with the special advice and consent of his majesty’s estates of parliament of this his ancient kingdom of Scotland, taking to their consideration the good, true and faithful service done to his highness and his progenitors in time past by Alexander Forbes of Ballogie, has ratified, approved and confirmed and, by this act, ratifies, approves and confirms the signature superscribed by his majesty, of the date at his majesty’s court at Whitehall, the […] day of […] 1681 instant, whereby our said sovereign lord, with advice and consent of the lords commissioners of his majesty’s treasury and exchequer, gave, granted and conveyed to his majesty’s beloved Alexander Forbes, elder of Ballogie, son to John Forbes of Pitnacalder and Jean Forbes, his spouse, in conjunct fee and liferent the longest liver of them two, during all the days of their lifetimes, and to Alexander Forbes, now their eldest lawful son, and the heirs lawfully to be procreated of his body, which all failing to return to the said Alexander Forbes, elder, his heirs and assignees whatsoever (under the provisions, conditions and reservations in favour of the said Alexander Forbes, elder, mentioned in the said signature) which are and shall be held as herein inserted, all and whole the lands and barony of Ballogie, with the mains and brae thereof, Diracroft, the town and lands of Mill of Hole, mill thereof, mill-lands, multures, sucken, sequels and knaveships of the same, and namely, these pertinents of the said lands of Mill of Hole called Woodside, Easter Mill of Hole, alias Mcterrie, with the hill called the Hill2 of Fare, and with the tower, fortalice and manor place of the said lands and barony of Ballogie and feu duties of the same, together also with these parts and pendicles of the said lands and barony of Ballogie and feu duties of the same, namely, that piece of land lying upon the south and west parts of Over Lurg, commonly called Tullochro and Bogquhask, with all and sundry houses, biggings, yards, orchards, tofts, crofts, outsets, insets, parts, pendicles and whole other pertinents of the said lands and barony whatsoever, lying within the parish of Midmar and sheriffdom of Aberdeen, which lands were formerly parts and pendicles of the lands and barony of Lumphanan and were thereafter erected and incorporated in a full and free barony, called the barony of Ballogie, upon the resignation of Robert Irvine of Fedderat, Alexander Irvine, younger thereof, his eldest lawful son, and Patrick Irvine of Beltie; whereby also his majesty, for the causes therein mentioned, did of new give and convey to the said Alexander Forbes, elder, his said spouse and son and their foresaids, the whole lands, barony and others particularly above-written, and did unite of new the same in a full and free barony, called the barony of Ballogie, and ordained the manor place of Ballogie to be the principal messuage of the said barony; to be held of our sovereign lord by service of ward and relief, in manner mentioned in the said signature. As also, our said sovereign lord, for the causes above-specified, and certain other causes and considerations, changed the holding of the said lands and barony of Ballogie, comprehending the whole lands, mill, mill-lands, multures and others above-written, lying within the parish of Midmar and erected in the said barony of Ballogie, from their former holding of simple ward to taxed ward, for payment of the sum of £40 Scots money to his majesty and his successors yearly, at Whitsunday [May/June] and Martinmas [11 November] by equal portions, during the space of the said ward and non-entry or either of them, and the like sum of £40 money foresaid for the relief of the same lands, when it falls, with the sum of £80 money foresaid for the marriage of the heir or heirs of the said Alexander Forbes, or his said son, together with the charter following or that shall follow upon the said signature, under his majesty’s great seal, precept of sasine to be therein contained and instrument of sasine to follow thereupon, in all and sundry heads, points, articles and clauses therein contained, after the form and tenor thereof. And our sovereign lord, with advice and consent of the said estates of parliament, statutes and ordains that this present ratification of the foresaid signature, charter, precept and sasine following or to follow thereupon is and shall be as valid, effectual and sufficient as if the same signature, charter, precept and instrument of sasine were at length herein inserted, dispensing by these words with the not inserting thereof in this act of ratification. Likewise his majesty, with advice and consent foresaid, wills, grants and ordains the lands, barony and others above-specified, in all time coming, to be held of his majesty and his successors by the said Alexander Forbes of Ballogie, his said son and their foresaids, in taxed ward for yearly payment of the tax duties of ward, relief and non-entry and tax values of the marriage above-rehearsed, notwithstanding that the lands, barony and others above-rehearsed were formerly otherwise held, and finds, declares, statutes and ordains that the foresaid signature, with the charter, precept and instrument of sasine following thereupon with the other rights and securities made to the said Alexander Forbes, his predecessors and authors of the lands, barony and others above-specified, shall be sufficient rights and securities for bruiking and enjoying the same lands, barony and others above-written, in all time coming, to be held of his majesty and his successors in taxed ward in manner above-rehearsed.
